.General Terms and Conditions of Sale (GTC)

Article 1: Fields and conditions of application.
These general conditions of sale apply to all orders placed on the site www.bluechem.shop
BLUECHEM-FRANCE reserves the right to modify these general conditions of sale at any time. In this case, the general conditions of sale in force will be applied to each order. Any customer who placed an order on www.bluechem.shop  is considered to have de facto and unreservedly accepted the general conditions of sale in force.
Article 2: Contract
2.1 Conditions for placing an order
You declare that you are at least 18 years old and have the legal capacity or hold parental authorization allowing you to place an order on the Site.
Any order made on the Site must correspond to the normal needs of a consumer. In this context, by agreement, certain references may be the subject of a limited number of sales per order.
2.2 Stages of conclusion of the contract
After placing your order, we send you an e-mail or an SMS, confirming the elements of your order. We inform you by e-mail of the sending of your articles. This e-mail constitutes our acceptance of your order and thus forms the sales contract between Us and You. These stages of conclusion of the contract apply regardless of the purchase procedure on the Site.

Article 3: Presentation of products
BLUECHEM-FRANCE cannot be held responsible for any errors in the descriptions, formulations or advice for use of the products. Photos and graphics have no contractual value and cannot call into question an order.

Article 4: Availability of products
Our products are offered within the limits of available stocks. In case of out of stock on one or more items of your order, BLUECHEM-FRANCE undertakes:
- To notify you by email or telephone as soon as possible
- To offer you other products that may be of interest to you
- To offer you, if necessary, to reimburse you.
Article 5: Product prices
The prices of our products are expressed in €uro and include all taxes (TTC) excluding participation in processing costs (see costs). They can be modified at any time and without notice. However, the products will always be invoiced at the rate in force at the time of the order. In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. For all products shipped outside the European Union and DOM-TOM, the price will be calculated excluding taxes automatically on the invoice.

An order is deemed to have been placed on www.bluechem.shop and the general conditions of sale accepted once you have clicked on the buttons "Validate"_cc781905-5cde-3194 -bb3b-136bad5cf58d_if you pay by credit card or "Payment confirmation by check" if you pay by check.
The data recorded by www.bluechem.shop  and our secure payment provider constitute proof of the nature, content and date of the order.
In case of unavailability of the product ordered, the customer will be informed as soon as possible. He will then be offered the option of modifying his order or canceling it.
www.bluechem.shop se reserves the right to refuse to honor an order from a customer who has not paid for all or part of a previous order or with whom a payment dispute would remain.

Article 7: Customs duties
Any order placed on www.bluechem-France.fr and delivered outside of France may be subject to any taxes and customs duties which are imposed when the package reaches its destination. These customs duties and these possible taxes related to the delivery of an article are your responsibility and are your responsibility. We are not required to verify and inform you of applicable customs duties and taxes. To find out about them, we advise you to check with the competent authorities in your country.

Article 8: Payment
The payment of your orders is made:
Either online, on the PAYPAL Site, by bank card: Carte Bleue, Visa, Mastercard/Eurocard, American Express.
Or by bank check. In the event of payment by bank cheque, this must be issued by a bank domiciled in metropolitan France or Monaco. Checks should be sent to the following address:

The check should be made payable to: Bluechem France
The cashing of the check and the shipment of the order are made upon receipt of the check.

Article 9: Shipping and Delivery
BLUECHEM-FRANCE undertakes to ship orders within 24 working hours. If this is impossible (out of stock, etc.), the customer will be notified as soon as possible.
In the case of an order comprising products with different shipping times, the shipping time of the order will be the longest of the products ordered. BLUECHEM-FRANCE reserves the right, in this case, to split shipments. Products purchased on www.bluechem-France.fr are delivered in Metropolitan France, DOM-TOM, European Union and International.  Delivery is made to the delivery address specified when ordering . The consumer is required to check the condition of the packaging of the parcel on delivery and to report any damage due to the carrier on the delivery note, as well as to BLUECHEM-FRANCE, within two working days.
As far as shipping is concerned, we work with Colissimo Recommandé  from La Poste and Chronopost. Colissimo is a fast delivery service (72 hours for mainland France).
www.bluechem.shop  cannot be held responsible for late delivery, being dependent on La Poste. Any erroneous or missing, and necessary, mention in the delivery address and the identity of the customer relieves BLUECHEM-FRANCE of the responsibility for the delivery.

Article 10: Withdrawal period and Return
Pursuant to the provisions of Article L.121-20 of the Consumer Code, you have a period of 7 days after receipt of your order to return a product if it does not suit you. Return costs remain your responsibility . These must be returned complete in their original packaging. Items returned incomplete, damaged, damaged or soiled by the customer will not be taken back.
In accordance with article L.121-20-1 of the Consumer Code, the returned product(s) will be refunded to you within 30 days of the date on which this right was exercised.

Article 11: Retention of title.
The goods delivered will remain our property until the customer has fulfilled all obligations towards us, and in particular until full payment of the price.

Article 12: Processing of personal and confidential data.
Your details (identity, address, email, telephone, etc.) are not transferred to any third party company.
So, all you have to do is write to us at info@bluechem-france.fr   to assert your rights.
Bluechem.shop like all e-commerce sites, uses cookies. The acceptance of cookies is necessary for the use of www.bluechem-France.fr. These small text files contain essential data for processing your orders. They do not contain any personal data.
Your payment details are not saved on our servers or known to any BLUECHEM-FRANCE employee.

Article 13: Intellectual Property
The texts, comments, works, illustrations and images reproduced on the site www.bluechem-France.fr are reserved worldwide under copyright and intellectual property.
As such and in accordance with the provisions of the intellectual property code, only use for private use subject to different or even more restrictive provisions of the said code is authorized. The products offered comply with the French legislation in force. The responsibility of www.bluechem-France.fr can not be engaged in case of non-compliance with the legislation of the country where the products are delivered. It is up to you to check with the local authorities the possibilities of importing or using the products or services that you plan to order.

We invite you to refer to the description of each product to find out its precise characteristics; and if in doubt or if you would like further information, do not hesitate to contact us. In the event of a manifest error between the characteristics of the product and its presentation and/or the conditions of the sale, the responsibility of www.bluechem-France.fr cannot be engaged.

BLUECHEM-FRANCE cannot be held responsible for the non-delivery of a product for out of stock, unavailability, disruption, total or partial strike of postal services and means of transport and/or communication; flood, fire, natural disaster or any other case of force majeure.

Article 15: Attribution of jurisdiction
The general conditions of sale presented above are governed by French law. Any dispute concerning these general conditions of sale will be submitted to the Commercial Court of LYON alone.
